Terms of Service

These terms cover the pool cleaning, repair and related services Arizona Aqua Pools LLC ("we," "us," "our") provides for homes in Gilbert and across the East Valley, and your use of this website. When you contact us about service, set up service with us, or use this site, you agree to them. If the service arrangement we agree on with you says something different from these terms, that arrangement controls for your service.

The Services We Provide

We provide residential pool services, such as weekly pool cleaning, pool repair, filter cleaning, green pool cleanup, acid washing, tile and calcium cleaning, and equipment replacement, as described on our pool services page. Prices and price ranges on this website are general information for typical pools. Nothing on this website is an offer to provide service at a particular price, on a particular schedule, or starting on a particular date. The arrangement we agree on with you is what describes your service and your price.

How Service Is Set Up

The details of any service, including the schedule, the work and the price, are agreed directly with Arizona Aqua Pools before work starts. For weekly service, we go over the monthly price and payment terms with you before the first visit. For repairs, equipment replacement and other one-time jobs, we tell you what we found and what the work will cost, and we do the work once you agree. If your pool's needs change, for example new equipment, a spa or a pool that needs extra work to recover, we talk it through with you and agree on any change before it takes effect.

Scheduling and Getting Into Your Backyard

When service can start, and which days we can come, depends on the work and on what's already scheduled. A start date or a service day is never a promise until we've agreed on it with you. To do the work, we need a way into the backyard and the equipment area: an unlocked gate, a gate code, a key or another arrangement you and we agree on. Tell us before the first visit about dogs or other pets, locked gates, alarms and anything else we should know about. Keep pets inside or away from the pool area during visits. If we can't get in on a scheduled visit, we'll reach out to sort it out.

Pool Chemicals and Safety

Pool care involves chemicals, and we add them to your pool as part of the service. Keep children and pets away from the pool area while we work, and follow any instructions we leave about when it's OK to swim. Don't add chemicals of your own between visits without telling us, since mixing products can affect the water balance and can be unsafe. Pool safety at your home, including fences, gates, covers, alarms and supervising swimmers, stays with you as the homeowner. Tell us about anything that affects how we can work safely, such as broken equipment, exposed wiring or a damaged deck.

Your Property and Equipment

We work in your backyard and on your pool equipment, and we treat both with care. If something is damaged after a visit, tell us as soon as you can so we can look into it together. We are not responsible for wear, damage or conditions that were there before a visit, for equipment that fails because of age or normal wear, or for conditions we weren't told about.

General Information Only

This website is general information about pool care. It is not a substitute for someone looking at your pool and equipment in person. Reading this site or sending us a message doesn't start service. Service starts only once we've agreed on an arrangement with you. If someone is hurt in or near a pool, or you see a fire or electrical danger, call 911.

Using This Website

This website explains what we do and how to reach us. You can send us a message through the form on the contact page. The form has spam protection, so a message that looks like spam may be filtered out before it reaches us, and email can fail, so if you haven't heard back, call (602) 384-6061. Please don't use the form for anything urgent. Call us instead, and in an emergency, call 911. How we handle what you send is explained in our privacy policy.

We don't sell anything online: the site has no shopping cart, checkout or customer accounts. You agree not to try to break into, overload or interfere with this site, copy it in bulk with automated tools, or use it for anything unlawful. The text, photos and logo on this site belong to Arizona Aqua Pools LLC or are used with permission, and you may not republish them without our written permission.

Limitation of Liability

To the fullest extent Arizona law allows, our liability for any claim arising out of our service or this website is limited to the amount you paid us for the service the claim relates to. We are not liable for indirect, incidental or consequential damages. Nothing in these terms limits liability that cannot be limited by law, and nothing takes away rights you have under Arizona consumer protection law that cannot be waived.

Governing Law and Arbitration

These terms and every agreement with us are governed by the laws of the State of Arizona, without regard to its conflict of law rules.

If a dispute comes up, call us first. Most problems are fixed with a conversation. If we cannot resolve it that way, you and Arizona Aqua Pools agree that the dispute will be settled by binding arbitration in Maricopa County, Arizona, before a single neutral arbitrator, rather than in court, and each of us gives up the right to a jury trial. Either party may instead bring a claim in small claims court if it qualifies. The arbitrator's decision is final and may be entered as a judgment in any court with jurisdiction.

You and Arizona Aqua Pools agree to bring claims only as individuals, not as a plaintiff or class member in any class, collective or representative action, and the arbitrator may not combine one person's claims with another's or preside over any form of class proceeding. If this class action waiver is found unenforceable for a claim, that claim will be decided in court and not in arbitration.

Changes to These Terms

We may revise these terms by posting a new version on this page with a new "last updated" date. The terms that apply to your service are the ones in effect when the service was arranged, unless we agree on something different with you.
